This new rule signed into law on January 13, 2023, gives AR Pistol owners and dealers until May 31, 2023 to take action to comply with its provisions. The new law redefines weapons classified as ?short-barreled rifles? under the Gun Control Act of 1968, making AR Pistols equipped with stabilizing braces subject to regulation under the National Firearms Act.?

?The rule outlines the factors ATF would consider when evaluating firearms equipped with a purported ?stabilizing brace? (or other rearward attachment) to determine whether these weapons would be considered a ?rifle? or ?short-barreled rifle? under the Gun Control Act of 1968, or a ?rifle? or ?firearm? subject to regulation under the National Firearms Act.
The rule?s amended definition of ?rifle? clarifies that the term ?designed, redesigned, made or remade, and intended to be fired from the shoulder? includes a weapon that is equipped with an accessory, component, or other rearward attachment (e.g., a ?stabilizing brace?) that provides surface area that allows the weapon to be fired from the shoulder, provided other factors, as listed in the definition, indicate the weapon is designed and intended to be fired from the shoulder.??
What Is a Stabilizing Brace??
A stabilizing brace, also called a pistol brace or an arm brace, is an attachment that mounts to the rear of a firearm to help anchor it to a shooter?s arm, enabling them to fire it one-handed. First designed for disabled veterans to be able to fire a pistol, they became popular options for many firearms, especially AR Pistol Kits.?
Most have a soft velcro loop that fastens around the arm or a stabilizing fin, or blade, that can be held against the upper arm or in the pit of the elbow. The fin is made from flexible rubber to fit comfortably in the curvature of the arm or elbow.?

If your particular model of AR Pistol Kit with attached stabilizing brace meets the new definition of a rifle or short-barreled rifle under the NFA, you have several options to remain legally compliant.?
- Register your AR Pistol with a brace by using an online form by May 31, 2023. Owners who do so are not required to pay the $200 tax).
- Remove the short barrel and attach a 16-inch or longer barrel.
- Remove the stabilizing brace in a manner that it cannot be reattached and dispose of the brace.
- Turn in your firearm to a local ATF office.?
- Destroy the firearm completely.?
